Privacy notice

This notice explains how we handle the personal information you give us through this sales portal for Zonnezicht Phase 5, Durbanville, in terms of the Protection of Personal Information Act, 2013 (POPIA).

1. Who we are

Personal information sent through this portal is handled by:

• Beadica 194 CC t/a House of Realtors, the sales agent for Zonnezicht, which runs this portal;
• RentalProp, the rental division of House of Realtors, for the rental list and rental assessment forms;
• the developer, Amphoria (Pty) Ltd and/or Anton Mulder Construction (Pty) Ltd, for communication and contracts about a purchase.

“We” and “us” in this notice mean these parties, with their directors, members, employees and agents.

3. What we collect

• Contact details on every form: first name, surname, email address and phone number.
• Registering to see prices: your contact details, whether you’re an owner-occupier, an investor or a tenant, and the apartment size you’re interested in. So you can sign in again on another device, our website host also keeps a coded copy (a one-way hash) of your email address and phone number, which can’t be read back as your details.
• Your enquiry: what you’re interested in, the unit, your message, a preferred viewing date, or a reservation request.
• The rental list: the age band of the youngest person who’ll live in the apartment (every resident must be 55 or older), who’ll live there, the apartment size, your rent budget, when you’d like to move in, and anything else you tell us.
• A rental assessment: your situation, the unit number(s), when you need a tenant, and any other property you’d like us to manage and where it is.
• How you found us: the page you sent the form from and any campaign tags in the link you used (for example “utm_source”), so we know which advert or post brought you.
• Health or care needs, only if you choose to tell us (for example under “Anything else?”). This is special personal information. We use it only, with your consent, to find a suitable home or service for you, and we share it only with the people who need it for that.
• Usage data: when website analytics is on, Google Analytics (through Google Tag Manager) records the pages you visit, the buttons you use, your device and browser, and your approximate location. It doesn’t record your name or contact details.

Kept on your device only: your “My list” of saved units, whether you’re buying to live in or to invest, whether you’re signed in to see prices (until you close your browser, or longer if you chose to stay signed in), your investment analysis settings and the last prime rate are stored in your browser so the portal remembers them. They aren’t sent to us, and clearing your browser data removes them.

4. Why we use it, and on what basis

• To answer your enquiry, arrange a viewing and handle a reservation request, through a sales consultant.
• To contact you when a suitable apartment becomes available to rent, if you joined the rental list, or to prepare a rental estimate and fee quote, if you asked for a rental assessment.
• To prepare and carry out a sale agreement or lease, if you go ahead.
• To improve the portal and see which adverts work, using totals rather than individuals.
• To meet legal duties, such as FICA verification and tax records.

We rely on your consent (the box you tick when you send a form), on steps towards or the performance of a contract with you, on our legitimate interests (improving the portal, preventing spam and fraud), and on legal obligations.

5. Who we share it with

• House of Realtors’ sales consultants for Zonnezicht, and RentalProp for the rental forms.
• The developer, for communication and contracts about a purchase.
• Service providers that process it for us: Netlify, Inc. (website hosting and forms), PropertyFunnels / LeadConnector (our customer database) and Google LLC (email and, when it’s on, website analytics).
• Regulators or law enforcement, only where the law requires it.

We don’t sell your personal information.

6. Information sent outside South Africa

Netlify, Google and PropertyFunnels may process information outside South Africa, mainly in the United States. We use providers that are bound by data-protection terms giving protection comparable to POPIA (section 72).

7. How long we keep it

• Enquiries, viewing and reservation requests: up to 36 months after our last contact with you, unless the law requires longer (for example after a sale) or you ask us to delete them sooner.
• The rental list: until you ask to be removed, and no longer than 36 months after our last contact.
• The coded sign-in copy: as long as your price registration, or until you ask us to delete it.
• Analytics data: as set in Google Analytics (14 months).

8. Your rights

Under POPIA you may ask us at any time to:

• confirm what personal information we hold about you, and give you a copy;
• correct or delete information that is wrong, out of date or no longer needed;
• stop using it, including for direct marketing, or withdraw a consent you gave.

Email admin@houseofrealtors.co.za. We may ask you to confirm who you are, and we reply within 30 days. You can also complain to the Information Regulator: inforegulator.org.za.

9. Direct marketing

We contact you about your enquiry, or about rentals if you joined the rental list. We don’t send unsolicited marketing without your prior consent, and every marketing message lets you opt out (section 69).

10. Security

We protect personal information with reasonable technical and organisational measures: encrypted connections (HTTPS), access controls on the form inbox and our customer database, and access for only the people who need it. If a breach affects your information, we’ll tell you and the Information Regulator as POPIA requires (section 22).

11. Other services

Links to WhatsApp, Google Sheets (the live availability, which holds no personal information) and the City of Cape Town’s website take you to services with their own privacy policies.

We may update this notice from time to time. The date at the top shows the latest version. See also our disclaimer.
